The registration and caveat systems under the mining act 1978 (WA): A Torrens clone?

Abstract

New legislation in WA has created a registration system for mining tenements which resembles the Torrens land title system - the new system gives the government greater control over the exploitation of natural resources - registration does not confer indefeasibility of title as is the case under the Torrens system, therefore there is greater uncertainty of title upon transfer of interests - Torrens case law is of limited application.
