Abstract

This chapter discusses the law regarding leases in Australia including leases under the general law and retail and residential leases legislation. The rights and obligations of lessors and lessees, the remedies available for breach, and the methods for terminating a lease are examined. The chapter discusses many of the practical aspects of proceeding through a retail and residential lease and illustrates the operation of the legislation by reference to recent cases.
