Mistaken payments: obligations of a recipient

Abstract

A wrongful payment must be remedied by restitution of the moneys received according to the law of unjust enrichment - the author argues that other obligations arise depending on when the recipient discovers the mistake - this may give rise to other remedies such as compensatory damages and account of profits for subsequent misuse of the funds.
