Abstract

With the growing recognition of cross border insolvency law and courts willingness accept jurisdiction based upon the concepts of centre of main interest and establishment, directors of multinational companies may be bound by duties imposed on hem by not only the State of incorporation but also those Sates where the company has its centre of main interest or an establishment.
