Abstract
The purpose of this document is to provide comments on a proposed Decree, which stipulates details and guides the implementation of the provisions of the Social Insurance Law related to the compulsory social insurance of migrant workers in Viet Nam. In accordance with the Terms of Reference or this assignment, the comments are intended to be aligned with international
labour standards related to social security and labour migrations, and illustrated by specific country experiences, to the extent relevant. The ILO has been requested by the Ministry of Labour, Invalids and Social Affairs (MOLISA) to provide these comments, to ensure compliance of the Decree with international standards and practices. The amended Social Insurance Law (hereafter: SI Law) was endorsed on 20 November 2014 and has come into force from 1 January 2016. Under the amended Law, for the first time, foreign nationals who hold work permits and engage in employment activities in Vietnam are eligible to participate in the compulsory social insurance scheme, with effect as of 1January
2018.
