Abstract

In Secretary of State for the Home Department v Skirpal, the Court of Protection confirmed that medical or therapeutic benefit will never be the sole considerations when making orders for the lawful taking of tissue from a patient who lacks capacity to consent, and will consider what a reasonable citizen would want
