My submission discusses the following matters: (a) the benefits of removing abortion from the Criminal Code; (b) difficulties with the statutory drafting of s 334(3)-(4) of the Health Act (Miscellaneous Provisions) Act 1911 (‘the Health Act’) which sets out when an abortion is justified; (c) substitute decision-making and the meaning of informed consent in s 334(3)-(5) of the Health Act; (d) the use of gendered language in any legislation relating to abortion; and (e) other matters the Department has sought feedback on.
